Wal-Mart Truck Driver Collides with Vehicle in Rib Mountain

RIB MOUNTAIN, Wisconsin — An accident involving an overturned tractor-trailer on Highway 51 near Highway N in Rib Mountain has left one person injured.
According to the Wisconsin State Patrol, the auto accident occurred at around 11:15 a.m. just south of Highway N.

Donald J. Kane, of Onalaska, was driving a Wal-Mart truck when it collided with a car driven by William T. Guenter of Gladstone, Ore., causing the truck to roll onto its side.

Kane sustained a minor injury and was treated and released from Aspirus Wausau Hospital. No word on whether Guenter was injured.

Wisconsin State Patrol continues to investigate the incident. The cause of the truck accident has yet to be determined.

Oklahoma minister dies following motorcycle accident

SAND SPRINGS, Oklahoma – A Sand Springs minister that had disappeared from his home has recently died of injuries from a motorcycle crash.

David Emigh, 58, the pastor of the Word of Life Fellowship in Sand Springs, was driving his 2002 Harley-Davidson motorcycle around 8 p.m. when he lost control and crashed into a tree. According to Oklahoma Highway Patrol, Emigh was heading north on Oklahoma 11 roughly five miles north of 156th Street North when the incident occurred.

Emigh was to St. John Medical Center in Tulsa, where he died from his injuries on Wednesday. He was last seen at his home on Monday.

Sand Springs Assistant Police Chief Mike Carter said that Emigh’s wife, Sharon Emigh, filed a missing person’s report on her husband at around 8:30 p.m. on Tuesday.

 

This was not the first time Emigh disappeared, however. On Dec. 15, 2010, he did not come home nor did he appear at his church. A passer-by in Cleveland spotted him two days later behind the wheel of his pickup truck in a Wal-Mart parking lot.

Emigh returned home that day.
Although his family has stated that he was “physically well,” authorities have stated that Emigh had “a medical issue that will be dealt with privately.”

Portland Fire Chief dies in two-vehicle collision

PORTLAND, Oregon – Portland Fire Chief Matt Aker has died from injuries sustained by a two-car collision.

Aker, 34, died on Saturday following an accident in which his motorcycle was hit by a car.

The incident occurred on Saturday around 4:30 p.m. Aker was heading westbound on Ind. 67 on his Harley Davidson Sportster motorcycle when he was hit by a Chevrolet Impala that was being driven by Doris A. Muhlenkamp, 64, of Portland.

Muhlenkamp, who was not injured, told police that she was facing south, looking to turn eastbound from the parking lot of the Portland Wal-Mart onto Ind. 67 when saw a white van heading westbound on the same road, turning into the Wal-Mart shopping center.

She claims she did not see Aker, whose motorcycle was behind the van, and collided with it. The impact ejected Aker from the motorcycle and he suffered fatal head and internal injuries.

Aker was airlifted to Parkview Hospital in Fort Wayne, where he was pronounced dead at around 5:50 p.m.

Muhlenkamp was issued an alcohol and drug test but the results were not specified in the police report. According to Portland law, those involved in a serious bodily injury or fatal accident are required to take a drug and alcohol test.

Members of the Portland Fire Department are grieving over the loss of one of their finest officers.

Task Force Commander Shannon Henry said that the area had lost “the best of the best.”

“Matt was a very intelligent person and just a great guy,” said Henry. “He’s one of those people who dedicated his life to serve the public in their time of need.”

Aker had been a Portland firefighter since 1997 and was appointed Portland fire chief in December 2007 by Mayor Bruce Hosier. Aker had been assistant fire chief since January 2005.

Supreme Court Justice Scalia involved in four-car accident

VIRGINIA – U.S. Supreme Court Justice Antonin Scalia has been fined $70 after rear-ending a car in a four-car collision on Tuesday.

The 75-year-old justice did not suffer any injuries in the accident which occurred on the George Washington Memorial Parkway in Virginia.

The road, which is a narrow and winding four-lane street, travels along the Potomac River and is a popular road to take by both commuters and tourists alike.

The road also goes past the nation’s capital, which was where Scalia was heading for work. According to authorities, Scalia was charged with being at fault for the rear-end collision.

The Judge has yet to comment on whether he will contest the fine or not.

Despite the incident, Scalia still managed to arrive on time at court on Tuesday before 10 a.m. when the first court proceedings began.

Disabled woman struggling with Wal-Mart lawsuit after being involved in a life-altering accident

JACKSON, Missouri – After sustaining severe brain damage due to a traffic accident in May 2000, Debbie Shank, 56, has undergone a series of legal and emotional battles that have affected her life to this day. Ten years ago, Shank was involved in a car accident that impaired her short-term memory and which left her confined to a wheelchair. She has since spent her days living in a nursing home struggling to gain the benefits she rightfully deserves.

One of the many legal cases she was involved in centers around her Wal-Mart health plan. Before the accident occurred, Shank was working for Wal-Mart and enrolled in their health plan. Two years after her accident, she was given $1 million in compensation from the trucking company that was involved in the accident. Once they paid the accident attorney fees, only $417,000 was left and in turn, was placed in a trust fund for Shank’s medical care.

Soon thereafter, Wal-Mart sued Shank for $470,000, the amount they had covered for her medical expenses. There is a stipulation in the health plan of the company that states that Wal-Mart has the right to recoup expenses paid to the employee if they collect compensation from a lawsuit – a clause Shank had not noticed. The court ruled that they could only take what was left in the trust fund.

Shank’s accident attorney, Maurice Graham, stated that he had previously contacted representatives at Wal-Mart and informed them of the settlement. It was his understanding that Shank would be able to keep her compensation.  ”We assumed after three years, they [Wal-Mart] had made a decision to let Debbie Shank use this money for what it was intended to,” Graham noted.

Shank and her family lost the lawsuit against Wal-Mart and tried to appeal the ruling but were unsuccessful. In the following week, their son was killed in Iraq.

Although agreeing that Shank’s case was “unbelievably sad,” when asked by CNN reporters why they pursued the lawsuit, Wal-Mart spokesman John Simley replied: “Wal-Mart’s plan is bound by very specific rules…done out of fairness to all associates who contribute to, and benefit from, the plan.”

Both the Shank family and their accident attorney believe that the super-giant corporation could have made an exception. The Shanks are in a financial crisis. Jim Shank, 56, is in remission from prostate cancer and has to work two jobs while still struggling to pay bills. Things are so grim for the family that as a last resort, Jim divorced his wife just so she would be able to receive a greater pension from Medicaid.

Angry and frustrated by his family’s situation, Jim tries to make sense of the situation. “Who needs the money more? A disabled lady in a wheelchair with no future, whatsoever, or does Wal-Mart need $90 billion, plus $200,000?” he wonders.

The Supreme Court continues to refuse their case but the Shanks haven’t lost hope. Ten years after the accident, they still struggle to have the Supreme Court hear their pleas in hopes that not only their family will be able to afford better treatment for Debbie, but to inspire those who are experiencing similar issues to fight for their benefits.
