Lawsuits Mount Against NECC as Meningitis Outbreak Widens, But How Many Could They Face?

Framingham, MA- Personal Injury and wrongful death lawsuits against New England Compounding Center are beginning to add up as the viral meningitis outbreak claims 23 lives with 284 individuals in 16 states showing signs of infection. 

At least 10 lawsuits against the Massachusetts-based pharmacy have already been filed, including one class action lawsuit. Even more of the victims have sought out the advice of accident and personal injury attorneys. So far cases have been filed in Indiana, Michigan, Massachusetts, Virginia, Florida, Minnesota, and New Jersey.

And the number of lawsuits could increase significantly. The CDC estimates that close the 1,400 people have received infected steroid shots that are used to treat lower back pain.

Earlier this month, the CDC discovered that the compounds used to make the injections had fungus in them. NECC has been cited on several occasions for violating drug regulations. The CDC has not indicated that the pharmacies’ suppliers are liable for the contamination.

So far, only NECC had been named in the lawsuits, but the doctors and pain management clinics who administered the shots are could also be sued.

“Anyone who got an injection can file a claim,” attorney Ann Andrews of Andrews & Thorton told the Wall Street Journal. Andrews predicts that NECC could face close to 5,000 lawsuits by the time the outbreak winds down.

Five Climbers Killed in Swiss Mountain Accident

GENEVA, Switzerland – Five people died Tuesday following a mountain climbing accident in Switzerland.

The five victims had reached the 4,010-meter (13,155-foot) high Lagginhorn summit, but as they began to descend, something went wrong and the climbers fell several hundred meters down the mountain.

A sixth climber who stopped before reaching the summit alerted the authorities of the accident but all five climbers died instantly.

The victims’ identities have yet to be released pending family notification.

Authorities have yet to determine the exact cause of the accident.

Utah Ranks 21st in the Nation for Injury-Related Deaths

SALT LAKE CITY, UT – A new report shows that Utah ranks 21st for injury-rated deaths in the United
States.

The Facts Hurt: A State-by-State Injury Prevention Policy Report, released Tuesday by the Trust for
America’s Health and the Robert Wood Johnson Foundation, examined each state and issued a report
card based on the steps each state has taken to prevent injuries on highways, homes and fields.

The study examined cases involving drunken driving, domestic violence, seat belts, and many other
incidents, leading each state to be ranked in 10 categories.

On a scale of one to 10, Utah scored 5.

“We weren’t that surprised by (the findings),” said Jenny Johnson with the Utah Department of Health’s
Violence and Injury Prevention Program. “We know that there are a lot of things that Utah does very
well, in terms of policies, and laws, in terms of injuries and violence prevention, but we also know there
are areas we need improve on.”

Using data from the U.S. Centers for Disease Control and Prevention’s Injury Statistics Query and
Reporting System, the report determined the number of injury-related deaths in each state per 100,000
people. Utah had 64.8 injury-related fatalities per 100,000 people, with the national total being 57.9 for
every 100,000 people.

Johnson also noted that the leading cause of death for people ages 1 to 44 is accidents, including car
crashes and drunken driving.

Montgomery Police Investigate Fatal Car-Truck Collision

MONTGOMERY, NY — Authorities are conducting an investigation into a fatal motor vehicle accident that took the life of a driver in Montgomery Wednesday morning.

Local police are still trying to identify the victim, who was killed after colliding with a mail delivery truck on Route 17K.

According to town police Chief Butch Amthor, the car was heading west near Bailey Road shortly before 5 a.m. when, for unknown reasons, it drifted into the eastbound lane, colliding with the truck.

Amthor explained the crash resulted in an explosion, engulfing the car in flames and trapping the driver inside. The victim was pinned in the vehicle, unable to escape.

The driver of the mail truck, whose name was yet to be released, was able to get out of his vehicle to safety. Aside from becoming unconscious following the collision, he escaped the accident unscathed.

The New York auto accident caused Baily Road to be shut down for nearly six hours.

A state police reconstruction team is currently assisting in the investigation to help identify the victim.
