Florida Man Awarded Over $3 Million for New Mexico Hot Air Balloon Accident

ALBUQUERQUE, N.M. – A New Mexico jury has awarded $3.86 million in damages to a Florida man who was injured in a hot air balloon accident in Albuquerque three years ago.

According to jurors, the pilot acted recklessly and the Balloon Fiesta organization’s negligence led to the plaintiff, Thomas Hurd, suffering debilitating injuries. The pilot, Timmerly Eklund, was found responsible for 60 percent of the judgment and the organization is responsible for 30 percent.

Hurd, of Port Charlotte, Fla., was found liable for 10 percent of the damages for the balloon accident on Oct. 5, 2009. According to the lawsuit, Hurd fell out of the gondola after it struck a tent on the fiesta field. He suffered a crushed pelvis, a broken back and hip socket, a crushed heel, and several other injuries. However, because Hurd signed an acknowledgment of risk before the ride, he released any negligence claims against Eklund. The jury had to make the decision as to whether or not she acted recklessly. The release did not waive negligence claims against the Balloon Fiesta.

Eklund admitted to having dropped the balloon to a height of about 15 feet, well below a 75-foot height requirement. She said she forgot about the requirement but tried to get around the tent by firing a burner. She admitted responsibility for the accident but denied that she acted recklessly.

Shane Sutton Suffers Injuries Following Bike Accident

Shane Sutton, the head coach of the British Cycling team and head coach at Team Sky, has sustained brain injuries following a bike accident just one day after Tour de France winner Bradley Wiggins was also injured in a similar incident.

The accident took place in Manchester, northwest England. Sutton was immediately transported to an area hospital, where he will remain for the next few days. Authorities say Sutton was wearing a helmet and will undergo additional tests to determine the extent of his injuries.

“It is extremely rare that our riders and coaches are hurt while out cycling on the road, even rarer that two incidents should occur in a short space of time, and we wish Shane and Bradley a speedy recovery,” said British Cycling in statement.

Wiggins, 32, collided with a vehicle near his home in Eccleston. He was released with minor injuries, including bruised ribs and hand, and is expected to make a full recovery. He was the first British winner of the Tour de France on July 22 and ten days later won his fourth Olympic gold medal at the London Games.

Nine People Injured Following Chicago Car Accident

CHICAGO, IL – Chicago accident lawyers may be needed soon following a car accident that left at least nine people injured.

The car accident occurred on the Northwest Side in Chicago’s Montclare neighborhood. Chicago Fire Department crews responded to the scene shortly around 3:30 p.m. near the intersection of Belmont and Oak Park avenues. Four People Killed in Early Morning New York Car Crash

WEST HEMPSTEAD, N.Y. — A Monday morning car crash in New York has left four people dead.

According to New York State Police, a car was sliced in half after crashing into several trees along a Long Island parkway Monday at around 4 a.m.  The names of the victims were not immediately released, nor were the specific details of the incident. A fifth victim was taken to an area hospital to be treated for unspecified injuries.

According to Amy Buchanan, who lives near the scene of the accident, the area is notorious for traffic accidents.

“I’ve lived here for 10 years and there has been an accident almost in that exact spot every year, but never as one as horrific as this,” she said.

The roadway was shut down for over five hours but reopened shortly after 10 a.m.

Is Batman Going Over to the Dark Side?

MICHIGAN – The “Caped Crusader” strikes again, only this time he’s not saving hundreds of people from an evil villain in Gotham City, but actually obstructing Michigan police from conducting an investigation into a personal injury accident.

Mark Wayne Williams, 33, was dressed as Batman when he was charged with one count of resisting and obstructing police as they conducted an investigation into an accident. Williams, called by local media the ‘Petoskey Batman,’ faces felony charges for obstructing an accident scene.

According to Michigan State Police Sgt. Jeff Gorno, Williams showed up at the scene Saturday night “in his Batman outfit” and “wouldn’t clear the scene.” He added that officers had a canine on the scene and Williams was interfering with the scent the canine was picking up.

While Williams was not carrying any weapons, his costume was confiscated. Maybe he should consider dressing up as Superman next time, or for Halloween.

While Batman was always one of the darker super hero characters, it seems as though Williams has a sinister past of his own. Last October he was sentenced to six months probation and was ordered not to wear costumes after he pleaded guilty to attempted resisting/obstructing an officer. He was arrested in May 2011 after being spotted atop a building while wearing a Batman costume.

Some  people never learn. There is only one batman, and while Williams shares the “Wayne” name, he is defiantly not the Bruce Wayne that we all know and love. He is now facing two years in prison and is due back in court on Oct. 18.
