If I’m Accidentally Injured, Why Do I Need a South Carolina Accident Lawyer?
May 9th, 2013

Beaufort, SC- Accidents whether they are on the road, at work or in our homes are inevitable. The majority of South Carolina residents have been involved in at least one accident in their lives. Some traffic collisions are minor, allowing those involved to walk away relatively unscathed, but there are times when these accidents are serious and the victims incur serious injuries or lose their lives.
Most people, who are involved in any type of accident, wonder if they really need to hire an attorney. The simple answer is yes; hire a personal injury attorney even if you don’t have intentions of pursuing a court case.
Past studies have shown that people who have legal representation walk away with more compensation than those who don’t hire an attorney even after the legal fees are paid.
Insurance companies are not on the personal injury victim’s side, they are primarily concerned with making their shareholders happy. And their main objective is to make a profit which is maximized when they pay as little for an insurance claim as possible.
Insurance companies employee numerous adjustors, investigators, and attorneys to work for them so you, as the victim, also need someone with knowledge and expertise when trying to secure a fair financial settlement for your pain and suffering. A South Carolina personal injury attorney is aware of the true value of your injury claim.
By hiring an injury attorney, you are sending a signal to the negligent party’s insurance company that you won’t settle for less than you deserve and having legal representation assures you won’t be taken advantage of in negotiations with the person responsible for your injuries and their insurer.
Never speak to the insurance company without speaking to your attorney first; the insurer wants to minimize their liability and increase their profits, so anything you say has the potential of damaging your case. Since your attorney better understands the language of the law always allow them to speak for you.
In South Carolina establishing negligence is the most important aspect of any personal injury lawsuit. To be eligible for compensation the victim must prove that the party that caused your injuries had a responsibility not to injure them and failed to live up to that duty. Also, the victim must prove there is a connection between the negligent party’s responsibility and the victim’s injuries and you suffered emotional and monetary losses as a result of the accident.
Once you have been involved in an accident, it’s critical that you contact an attorney immediately; you have a limited amount of time to file for a claim. In South Carolina, personal injury suits must be filed within 3 years from the date the injury occurred.
This gives your legal representative the opportunity to gather evidence and speak with witnesses while the incident is still fresh in their minds, allowing them to firmly establish who was negligent and responsible for a victim’s injuries. The longer an attorney has to work on the case the better chance they have of getting you a generous settlement that adequately compensates you for the suffering you’ve endured.
NTSB Investigating Texas Train Accident That Killed Four Veterans

Midland, TX- A veteran’s parade in Midland, Texas turned tragic Thursday when a train stuck a semi-truck at a crossing, killing four people and injuring 16.
Though this was supposed to be a celebration, it soon became a tragedy when two flat-bed trucks, carrying wounded veterans and their families to a banquet, were crossing a set of train tracks. The first flat-bed cleared the tracks, but right as the second began to go through the crossing an eastbound Union Pacific train slammed into the truck.
Four of the veterans on the float were killed and 16 others were injured. As of Friday afternoon, 5 of the injured were still in the hospital with only one person listed on critical condition.
Early Friday, officials from the NTSB arrived in Midland to investigate the cause of the accident. A representative from Union Pacific said that the crossing gate and lights were in working order.
At the time of impact, the train was only traveling at 70 mph and the driver had applied the emergency brakes, but not soon enough to avoid a collision.
Investigators are hoping the train’s black box will reveal more information about the cause of the accident, but it can take months before the NTSB is able to pinpoint the cause.
The parade was organized by a local group as way to salute local veterans. Besides the parade events for the day included a banquet and a weekend deer hunt for veterans, but they were canceled.
Train crossings and tracks can be dangerous so drivers or pedestrians should pay careful attention when driving across tracks or walking along them.
Any time a person loses their life or are killed in an accident, there is a chance that negligence played a part. When victims have medical bills and other related costs to worry about, they have the choice to hire an accident lawyer to seek compensation from the negligent party or work to maximize the settlement offered by an insurance company.
Did a Chicago Police Officer Stage an Accident?

A Chicago police officer has been accused of staging an accident between two cars in return for $2,000 from a tow truck driver who hauled away the wrecked vehicles and billed an insurance company.
Gregory Garibay, the officer in question, is also being charged with falsifying a police report and wrongly listing the driver with the best insurance coverage as at fault so the tow truck driver would have a larger compensation.
The incidents stem back to 2007, when Garibay was assigned to the South Chicago District. After authorities uncovered his crimes, Garibay was relieved of his position after 18 years with the department.
According to an indictment against Garibay, he filed a police report stating that the driver of Toyota Avalon, who had full insurance coverage, was at fault in a traffic accident with the driver of a Toyota Camry, who had only liability insurance coverage. This would ensure that the full insurance coverage would cover part – if not all – of the damage caused by the accident, including the towing fees. The tow truck driver later paid Garibay.
In another instance, Garibay was involved in a staged accident so another insurance company would pay for damages, including the towing fees.

Kansas Construction Workers Free Boy From Underneath Vehicle Following Accident

Independence, KS- Long before emergency crews could arrive; a group of construction workers sprang into action and freed a 12 year-old boy from underneath a van Tuesday afternoon.
During rush hour traffic, a boy, Gary Hibbs Jr., attempted to cross the four lanes of East 23rd Ave. traffic on foot when he was struck by a passenger van, and became trapped underneath. Just across the street, several construction workers were watching the events unfold and rushed to help the pinned boy.
Together several men lifted the van’s front end and pulled Hibbs Jr. to safety. When emergency crews arrived he was taken to local hospital and treated for a broken collarbone and numerous abrasions.
One of the construction workers who helped free the boy, L.J. Fanning told The Kansas City Star, “He just darted across the road.”
Fanning added that the boy rolled up on the windshield of the van before it came to a stop and the vehicle rolled over Hibbs Jr.
“We just kind of lifted up the front end of the minivan and told the driver to put the vehicle in reverse,” Fanning said, “After we got him free he was unresponsive and I thought he might be dead.”
Hibbs Jr. was much luckier than other accident victims. Pedestrians often incur serious or grave injuries after being struck by a car. In addition to trying to heal from their injuries, accident victims must also worry about their medical bills and other expenses.
But injury victims don’t have worry alone, when they have a qualified accident lawyer by their side, they can rest knowing someone is fighting for their rights. A strong case can result in a favorable settlement to a person injured by a careless driver.
